Artwork and Intellectual Property Policy

Last updated: 4 October 2026

This Artwork and Intellectual Property Policy applies to artwork, logos, text, images, designs, photographs, fonts, files and other materials supplied to or created in connection with orders placed through PrintSide.eu.

The PrintSide.eu online store is operated by Khodus Digital OÜ.

This Policy forms part of our Terms of Sale. Nothing in this Policy limits any mandatory rights that cannot lawfully be excluded.

1. Scope

This Policy applies whenever a customer uploads, emails, links to, describes or otherwise supplies material for printing, engraving, embroidery, reproduction, adaptation or other use by PrintSide or its production partners.

It also applies to print proofs, visualisations, layouts, templates and production files prepared by PrintSide in connection with an enquiry, quotation or order.

2. Customer-supplied materials

Customer-supplied materials may include logos, trade marks, business names, photographs, illustrations, drawings, text, slogans, packaging artwork, fonts, stock images, brand guidelines, design files and images of identifiable persons.

Supplying a file to PrintSide does not transfer ownership of that file or of the intellectual property rights in it to PrintSide, except for the limited permission required to perform the order as described below.

3. Customer representations and responsibility

By supplying any material, the customer confirms that:

  • the customer owns the material or has obtained all licences, consents and permissions required for the intended use;
  • PrintSide, its employees, contractors, suppliers and production partners may reproduce, adapt and apply the material as necessary to prepare and fulfil the order;
  • the material and its intended use do not infringe copyright, trade mark rights, design rights, rights in a business name, image rights, privacy rights, moral rights or any other rights of a third party;
  • all persons identifiable in supplied photographs or artwork have given any consent required for the intended commercial use;
  • the material is not unlawful, misleading, defamatory, threatening, discriminatory or otherwise prohibited;
  • the information provided about ownership and permission is accurate and complete.

The customer remains responsible for the content, legality, accuracy and authorised use of all supplied materials, including materials supplied by the customer’s employee, agency, designer, contractor or end client.

4. Limited licence granted to PrintSide

The customer grants PrintSide a limited, non-exclusive, worldwide and royalty-free licence to use the supplied materials solely as reasonably necessary to:

  • review the enquiry and prepare a quotation;
  • check file suitability and prepare artwork;
  • create and send a print proof or visualisation;
  • reproduce, resize, crop, convert, separate colours or otherwise technically adapt the material;
  • manufacture, decorate, inspect, package and deliver the ordered products;
  • share the material with suppliers and production partners involved in the order;
  • retain an order record, handle complaints and comply with legal obligations.

This licence lasts only for as long as reasonably necessary for those purposes and does not permit PrintSide to sell or publicly use customer artwork for unrelated purposes.

5. No public portfolio or marketing use without permission

PrintSide will not intentionally publish customer-supplied artwork, branded products or identifiable order details in a public portfolio, advertisement, social-media post or other marketing material without the customer’s separate permission.

Anonymised or aggregated operational information that does not reveal the customer, artwork or confidential business information may be used to improve our services.

6. Third-party intellectual property

Logos, characters, photographs, artwork, fonts and other content found online are not automatically free to use. Purchasing a copy of an image, possessing a physical item or finding material through a search engine does not necessarily grant reproduction or commercial-use rights.

The customer is responsible for reviewing the terms of any stock library, font licence, design marketplace, software platform, artificial-intelligence service or other source used to obtain or create the material.

Where a licence limits quantities, territories, products, methods of reproduction or commercial use, the customer must ensure that the intended order falls within those limits.

7. Trade marks and brand assets

The customer must have authority to use every trade mark, logo, business name, certification mark, organisation emblem or other brand asset supplied for an order.

PrintSide may request evidence of ownership, a licence, written permission or authority to act on behalf of the rights holder. The absence of such a request does not mean that PrintSide has verified or accepted the customer’s rights.

8. Images of people and personal information

If supplied material identifies or depicts another person, the customer is responsible for having a lawful basis and any consent required to provide and use that material.

Customers must not upload identity documents, payment-card details, medical information or other sensitive personal information unless strictly necessary and agreed with PrintSide in advance.

Personal information is handled in accordance with our Privacy Policy.

9. Artificial-intelligence-generated material

If artwork was created or modified using an artificial-intelligence service, the customer is responsible for checking the service terms and determining whether the material may lawfully be used for the intended commercial purpose.

The customer must also assess whether the generated material reproduces or imitates protected characters, brands, artwork, designs, persons or other third-party material.

PrintSide does not guarantee that artificial-intelligence-generated material is original, registrable or free from third-party claims.

10. Prohibited material

PrintSide may refuse, suspend or cancel work involving material that we reasonably believe:

  • infringes or may infringe intellectual property or other third-party rights;
  • uses a logo, brand or protected character without credible authority;
  • is unlawful, fraudulent, defamatory, threatening or discriminatory;
  • promotes violence, hatred, abuse or illegal activity;
  • contains sexual content involving minors or otherwise unlawful sexual content;
  • misuses official documents, currency, security features, state symbols or regulated marks;
  • could create a material legal, safety or reputational risk.

PrintSide is not required to provide production services for every submitted design. Where an order is refused or cancelled, any refund will be determined according to the stage of work, costs already incurred, applicable law and our Terms of Sale.

11. No general duty to verify ownership

PrintSide may perform reasonable checks but is not a legal adviser, trade mark registry, copyright-clearance service or licensing authority.

We are not required to independently investigate the ownership, registration status or licensing history of every file supplied by a customer. Any technical review of a file does not constitute legal approval of its content.

12. PrintSide-created artwork and production materials

PrintSide and its licensors retain ownership of their pre-existing intellectual property, including website content, software, templates, mock-ups, production methods, technical specifications, libraries, design elements and know-how.

Unless a written agreement expressly provides otherwise, editable source files, working files, templates, colour separations, production files and manufacturing instructions created by PrintSide remain the property of PrintSide or the relevant production partner and are not automatically supplied with the finished products.

Payment for printed or decorated products does not by itself transfer ownership of PrintSide’s pre-existing materials or internal production files.

If PrintSide is separately commissioned to create an original design, ownership and permitted use of that design will be determined by the relevant quotation or written agreement. In the absence of an express assignment, intellectual property rights are not transferred merely because design services have been paid for.

13. Print proofs and technical adaptations

The visual created in the customizer is a preliminary illustration, not the final production proof. After reviewing the order, PrintSide prepares the final production proof with the manufacturer and sends it to the customer for approval. Production starts only after the customer approves that final proof and PrintSide confirms the approved version to the manufacturer.

PrintSide may make technical changes necessary for production, including resizing, cropping, converting file formats, creating outlines, adjusting resolution, separating colours or repositioning artwork within the agreed decoration area.

The customer must carefully review the print proof and notify PrintSide of any required correction before approval.

Approval of the print proof confirms the visible content, spelling, orientation, approximate placement and other displayed elements. It does not transfer intellectual property rights or confirm that the customer has permission to use the artwork.

14. File quality and production suitability

The customer is responsible for supplying artwork of sufficient quality and in a suitable format. PrintSide may warn the customer about an obvious technical problem but is not required to identify every defect in a supplied file.

PrintSide is not responsible for pixelation, blurred output, missing elements, substituted fonts, incorrect colours or other issues directly caused by an unsuitable, incomplete, corrupted or low-resolution source file where the issue was visible in, or reasonably followed from, the approved proof.

15. Storage and deletion of artwork

PrintSide may retain customer artwork and related production files to fulfil the order, handle complaints and facilitate a possible repeat order.

Uploaded artwork intended for repeat orders will not be retained for more than five months after completion of the order, unless longer retention is required by law, necessary for a dispute or legal claim, or otherwise agreed with the customer on a lawful basis.

Customers should retain their own original and print-ready files. PrintSide does not guarantee that files will remain available for a future repeat order and may delete them earlier when they are no longer required.

16. Intellectual property complaints

A rights holder who believes that material used in connection with a PrintSide order infringes their rights may contact shop@printside.eu.

The notice should include:

  • the rights holder’s name and contact details;
  • identification of the protected work, trade mark, design or other right;
  • an explanation of the complainant’s ownership or authority to act;
  • identification of the allegedly infringing material or order, where known;
  • supporting registration records, licences, links, images or other evidence;
  • a statement that the information supplied is accurate.

PrintSide may suspend production or disclosure while reviewing a credible complaint and may request additional evidence from the complainant or customer. We may disclose relevant information where required by law or necessary to establish, exercise or defend legal claims.

17. Claims and responsibility

If a third party makes a claim relating to customer-supplied material, the customer must reasonably cooperate by providing evidence of ownership, permission or licensing.

To the extent permitted by law, a business customer is responsible for losses, liabilities, reasonable legal costs and third-party claims resulting from the business customer’s breach of this Policy or unauthorised material supplied by or on behalf of that customer.

Nothing in this section excludes or limits liability or mandatory consumer rights that cannot lawfully be excluded or limited.

18. Confidentiality and production partners

Customer artwork may be shared with employees, contractors, suppliers and production partners only to the extent reasonably necessary to prepare and fulfil the order, perform quality control, resolve a complaint or comply with legal obligations.

Where artwork contains confidential business information, the customer should notify PrintSide before supplying it so that any additional requirements can be considered and agreed in writing.

19. Governing law and disputes

This Policy and disputes relating to artwork or intellectual property are governed by the laws of the Republic of Estonia, subject to any mandatory rights that apply under European Union law.

The parties should first attempt to resolve a dispute through direct communication. If a dispute cannot be resolved, it may be referred to the competent authority or court. Consumers may also use the dispute-resolution options described in our Terms of Sale.
